Sealed vs Expunged Criminal Records
Sealed and expunged records both limit public access, but they are not identical. The research notes that expunged records do not appear in AOC criminal background reports. AOC also says dismissed-with-prejudice and acquitted cases on or after July 15, 2020, excluding traffic cases, are automatically expunged after 30 days unless the defendant objects. For many qualifying Class D felonies under KRS 431.073, a person cannot apply sooner than five years after completing sentence or probation or parole, whichever is later.
